Terms and Conditions

Please read through our Terms and Conditions and feel free to voice any issues that may arise. It is also important to let us know of any Terms and Conditions, or expectations of your own that you would wish to be included before work begins.

1. Our estimates are produced with as much detail as possible to avoid any misunderstandings. If something is missing that you would like included, please let us know and we will revise the estimate accordingly. Any additional works found necessary are to be agreed with the client and a separate revised or extra contract estimate provided, either verbal or in writing, with an aim to produce in writing within 30 Days.

2. Working Arrangements: All prices quoted are calculated on the basis of free access and unimpeded working during our normal working hours (8 am – 5 pm Mon – Fri), unless otherwise agreed by A.J.P Services in writing. We reserve the right to administer Charges for telephone calls and any need to attend the site outside our Normal business hours at our current callout rate (£150/ Hour or part thereof excluding VAT)

3. Both Contractor and client to agree practical arrangements on working methods that provide minimum disruption to the client and allow work to be carried out efficiently by the contractor within our standard hours of business.

4. Free access is required for delivery of building materials, plant, machinery and skips etc.

5. All building and other materials provided by the main contractor or their sub-contractors remain the property of A.J.P Services until full and final payment is received via Bank Transfer, cleared cheque or cash (see item 9).

6. Access to and collection of used or unused building materials, equipment and plant etc remains in place until full and cleared final payment is received.

7. Accepting a quotation or estimate, either verbally or in writing, and agreeing to the commencement of works will allow these terms and conditions to come into affect.

8. The main contractor being ‘A.J.P. Services’ may employ both direct and sub-contract labour to work on site. Each individual contractor takes full responsibility for their own third party liability. The main contractor will oversee all works to completion and takes full general and operational responsibility in the running of any contract agreed with the client.

9. Payment can be made via Bank Transfer, by cheque or in cash and a receipt for payment will be given for all cash payments. Please make all payments by cheque payable to ‘A.J.P. Services’. Bank Transfer details upon request. Payment in full is due upon completion of the contract and presentation of the associated invoice. Part payments, interim payments and deposits will be required for contracts in excess of £1000, agreed prior to commencement of works or during the contract duration. A down payment is not usually required however arrangements will be made for a down payment in respect of the acquisition of bespoke or high value materials.

10. Credit Limit. A maximum credit Limit for completed work of £10,000.00 including VAT will be allowed to Clients of good payment history. Should accounts exceed this, a payment will be required even if the invoice due date has not been reached prior to the Works continuing. We reserve the Right to shorten pre-agreed payment terms in the case of Invoices failing to be settled by due date. We also reserve the Right to “Temporary Suspension of Work” in respect of this situation, causing no breach of contract by “A.J.P. Services”

11. Late or incomplete Payment, we reserve the right to issue a late payment charge to the Client of 8% per calendar month or part thereof above The Bank of England Interest Rate. All charges, costs and commissions will be added to the Customers outstanding account as well as the Administration costs of “A.J.P. Services” in the pursuance of non-payment and reserve the right to “Temporary Suspension of Work” in respect of this situation, causing no breach of contract by “A.J.P. Services”

12. Invoice dispute, in the unlikely event of invoice dispute, any dispute must be lodged within 14 Calendar days of Invoice Date, any dispute after that time will not be heard and treated as Late or incomplete payment (See section 9)

13. Insurance and Public Liability: Public Liability Insurance is provided up to the sum of £2,000,000 by NFU Mutual. All usual general building practices are covered within our insurance policy. Policy details and certification is available on request.

14. All client information is retained in accordance with the Data Protection Act 1988 and all personal and other client details will remain confidential.

15. In the event of unforeseen difficulties arising, or any other circumstantial changes, the quotation price or estimated cost may be revised to reflect the situation at hand. Notice will be given either verbally, via email or in writing, with an aim to confirm either in writing or email within 28 days.

16. Guarantees: All customers will benefit from a full guarantee on our workmanship for a period of 12 months. Guarantees on materials run in accordance with manufacturer's warranty periods where applicable. Our guarantee covers all new work and new materials used in construction or repairs, but does not guarantee the integrity of any existing structures, materials or decorations. In the event of a failure beyond the guarantee period we will be happy to investigate the cause and negotiate a solution to the problem without delay and carry out any agreed repairs as soon as possible. Charges may apply for remedial work carried out beyond guarantee dates or to items not covered by our guarantee. Decorations, Glass, Timber Beams and reclaimed materials are signed off on completion of the phase of work and not covered by guarantee. No guarantee is issued or implied in respect of customers with any outstanding payment, either in full or any part thereof.

17. No responsibility is taken by ourselves for the presence of perished or rotten timber (or any other perished or rotten materials) in existing structures, doors, windows and frames whether detected or undetected at the time of contract.

18. Variation to contract, will only be undertaken further to both full discussion with the client, and, verbal or written agreement, and charged at the agreed rate.

19. Intellectual property. All tooling, drawings, designs and calculations sought or supplied remain the property of “A.J.P. Services” All copyright, design right, patent, registered designs, unregistered designs, Tooling, know-how and other intellectual property rights in the United Kingdom and abroad (“IP Rights”) in any information, documentation and other materials of whatever nature provided to the Client by A.J.P. Services in connection with the Works shall remain at all times the property of, and vested in, A.J.P. Services. IP Rights owned by A.J.P. Services will only be used by the Client during the contract. For the avoidance of doubt, it is agreed that all IP Rights in any design concept, technology or Tooling developed prior to or during the contract will remain in the ownership of “A.J.P. Services” and physical items associated.

20. Protection of existing surfaces (floors, carpets, curtains, doors and furniture etc). Whilst we endeavour to protect existing surfaces with the use of dust sheets and loose plastic sheeting etc along with care in our working practice, responsibility for protection from damage of any existing surface or fabrics etc is the responsibility of the Client. Clients are asked to remove all personal property and soft furnishing, including carpets from the affected areas. Arrangement can be made to put in place protection of existing surfaces, over and above our basic cover, at a negotiated additional cost. Furniture removal will not be undertaken other than at the full risk of the client by “A.J.P. Services” and will be chargeable.

21. Discounts and retentions: Prices are based on the understanding that no retentions are held unless previously arranged and authorised in writing by “A.J.P. Services”. No Main Contractor or Sub Contractor discounts are given unless agreed and confirmed in writing.

22. We will endeavour to employ a helpful attitude at all times and will always attempt to bring the building works to a satisfactory conclusion as soon as possible taking into account weather conditions and availability of specialist materials and unforeseen circumstances etc. No time penalties will be entered into, Extended charges for Scaffolding, Pavement licenses, Skip or Plant hire will be the responsibility of the Client in this event.
